Mining, issuance and validation fall in Category B. The simplified regime uses 0.15 or 0.95 by activity. A reporting provider communicates by 31 May. The 31 May report covers the preceding calendar year.

Timing and Possible Delays

Set by the tax year and transaction records

What delays it

The work takes longer when an exchange export is incomplete, wallets cannot be reconciled, received-asset records are missing or the activity spans several countries and tax years.

What to prepare now

Organise your residence, wallet, exchange, activity, foreign-tax and prior-filing records before the work begins.

Wallet Records, Classification and Reporting

The wallet and activity ledger

A certified accountant labels each line by acquisition, disposal, remuneration, mining, issuance or validation so the CIRS category rests on an identifiable transaction history. A certified accountant then separates habitual activity from isolated transactions before applying the relevant reporting treatment.

The evidence for the holding period

A certified accountant links the original acquisition to each later disposal or crypto-for-crypto exchange before applying the 365-day rule and any carried-forward value. You should preserve the export metadata that shows the wallet or exchange source when a transaction history spans multiple platforms.

The provider report and your return

Provider statements are stored with the wallet ledger, and the records that support your own Portuguese IRS return are marked. A certified accountant then checks the provider data against your income and disposal schedule before the agreed return is prepared.

Common questions

How does Portugal tax remuneration received in crypto-assets?
Article 5(2)(u) and Article 5(11) of the CIRS place remuneration from crypto-asset operations in Category E and treat received crypto-assets as a capital gain when you later alienate them. The rule applies according to the way the assets were received.
Which crypto-asset disposals fall under Article 10?
Article 10(1)(k) of the CIRS covers onerous disposals of crypto-assets that are not securities. Article 10(21) excludes unique, non-fungible crypto-assets from the Article 10(20) definition of a crypto-asset, so the asset is classified before the result is calculated.
What is the 365-day crypto holding rule?
Article 10(22) of the CIRS excludes gains and losses from Article 10(1)(k) operations when you held the crypto-assets for at least 365 days. You need acquisition and disposal records to prove the period.
What rate applies to crypto-asset gains?
Article 72(1)(c) of the CIRS applies a 28% autonomous rate to the positive balance of gains and losses from the Article 10(1)(k) operations, subject to the article's remaining rules and any applicable aggregation election.
Can crypto gains be aggregated with other income?
Article 72(14) of the CIRS can require mandatory aggregation for certain sub-365-day operations when taxable income, including the balance, reaches the top Article 68 bracket. Other crypto-asset disposals under Article 10(1)(k) remain under the 28% rule without that mandatory aggregation.
How does Portugal tax mining or validation?
Article 4(1)(o) of the CIRS treats issuance, mining and validation through consensus mechanisms as Category B commercial or industrial activities. The activity records and the applicable regime then determine the treatment.
Which simplified-regime coefficient applies to crypto activity?
Article 31(1)(a) of the CIRS uses a 0.15 coefficient for crypto-asset operations other than mining, while Article 31(1)(d) uses 0.95 for mining. Article 31(3) aggregates the resulting taxable income under the general rules.
How are crypto-for-crypto exchanges recorded?
Article 10(23) of the CIRS carries the acquisition value forward when the consideration is crypto-assets and the 365-day exclusion does not apply. The original acquisition is reconciled with the later exchange.
When must a crypto-asset service provider report to AT?
Article 124-A(3) of the CIRS requires a reporting crypto-asset service provider to report relevant information for the preceding calendar year by 31 May each year to the Autoridade Tributária e Aduaneira. This provider filing does not replace your own tax-return obligations.
